hereinafter referred to as providers, the contract is.

Contract object

With this agreement, the sale of new goods and services in the fields of hardware, software, multimedia technology, internet, e-commerce and digital photography through the online shop is controlled by the provider, because the details of the respective offer is made in the product description of the supply side.

Conclusion

The contract is only exclusive for the electronic commerce over the shop system. Here the rates shown are a non-binding solicitation of an offer by the customer order, which the supplier can then accept. The ordering process for contract conclusion comprises shop system in the following steps:

  • Selection of the offer in the required specifications (size, color, number)
  • Inserting the offer to the cart
  • Pressing the button ‘PROCEED TO CHECKOUT’
  • Entering the billing and possibly alternate delivery address
  • Choice of payment method
  • Review and processing of the order and all entries
  • Pressing the button ‘PLACE ORDER’
  • Confirmation email that your order has been received
  • By sending the order confirmation of the contract.

Contract duration

The contract is concluded for an indefinite period.

Retention of title

Until full payment of the delivered goods the goods remain the property of the provider.

Reservations

The provider reserves the right, in case of unavailability of the promised services and products not to provide this.

Prices, shipping costs, return costs

All prices are final and include VAT. In addition to the final product cost there are shipping costs. Depending on shipping method additional costs will be displayed before sending the order. By returns the customer bears the cost of returning.

Terms of payment

The customer only has the following options for payment: bank transfer, payment service (PayPal) and credit card. Other payment methods are not available and will be rejected.

Delivery Terms

Goods will be sent immediately after confirmed receipt of payment. The shipment will be an average of latest after 3 days. The contractor undertakes to supply on the 14th day of order. The standard delivery time is 5 days, unless the item description is stated otherwise. The supplier will ship the order either from its own warehouse when the entire order is available or the order will be shipped by the manufacturer, when the entire order is available. The customer will be informed promptly of delays. If the Provider has a permanent obstacle to delivery, in particular force majeure, or non-delivery by own supplier, a timely correspondence will be made. The seller has the right to withdraw the extent of a contract with the customer. The customer will be informed immediately and payment refunded.

Warranty

Consumers have a statutory warranty rights under the relevant provisions of the Civil Code (BGB) for the services offered. If departing therefrom, the warranty shall be for the purpose drafted regulations in the General Terms and Conditions (GTC). For entrepreneurs, the warranty period is limited to one year for new goods. The seller is granted that he himself can choose between repair or replacement at a subsequent performance if it is the product is virgin and the customer is an entrepreneur. For entrepreneurs, the warranty is excluded for used goods. If the customer is a consumer, the warranty period is limited to one year for used goods. This does not apply to claims for damages by the customer due to injury to life, limb, health or essential contractual obligations, which must necessarily be met to achieve the Treaty’s objectives. Likewise, this does not apply to claims for damages for gross negligence or intentional breach of duty of the provider or his legal representative or his assistants. Otherwise, the statutory provisions apply.

You have the right to return within fourteen days without giving a reason.

The return period shall be fourteen days from received date.

To exercise your right, you have to write (AURORA skycam UG, Bahnhofstr. 101B, 16359 Biesenthal, Germany, +49 3337 451 904, info@aurora-skycam.com) by means of a clear statement (eg a consigned by post mail, fax, or e-mail) about your decision to withdraw from this contract, inform. You can sure use the attached model withdrawal form, but are not required.

To safeguard the return period it is sufficient that you send your communication concerning the exercise of the withdrawal before the expiry of the withdrawal period.

 

Effects of return
If you revoke this contract, we return all the payments we have received from you, including the costs of supply (with exceptions of the additional costs incurred from the fact that you have chosen a type of delivery other than the one offered by us, favorable Ground Shipping), and repay immediately latest within fourteen days from the date of which the notification has been received of its cancellation of this contract with us. For this repayment we use the same method of payment that you used in the original transaction, unless you expressly ask otherwise; in which case you will be charged fees for this repayment. We may withhold reimbursement until we have received the returned goods back, or until you have demonstrated that you have returned the goods, whichever is the earliest.

You have to send the goods immediately and in any event not later than fourteen days from the date on which you inform us about the cancellation of this contract, to AURORA skycam UG, Bahnhofstr. 101B, 16359 Biesenthal, Germany, +49 3337 451 904, info@aurora-skycam.com returned to us or to hand over. The deadline is met if you send the goods before the deadline of a fortnight.

You bear the direct cost of returning the goods.

You have to pay for any diminished value of the goods.

End of Return Conditions

Disclaimer

The customer claims for damages are not excluded due to breach of the customer’s life, body, health or essential contractual obligations, which must be met to achieve the Treaty’s objectives.

Likewise, this does not apply to claims for damages for gross negligence or intentional breach of duty of the provider or his legal representative or his assistants.

This also applies to the representatives and agents of the provider, if the customer does claims for damages against them.

Assignment and pledging ban

Claims or rights of the customer against the supplier shall not be assigned or pledged without the latter’s consent, unless the customer has established a legitimate interest in the assignment or pledge.

Language, Jurisdiction and Applicable Law

The contract will be drafted in German. The further implementation of the contractual relationship takes place in German. There is only the law of the Federal Republic of Germany. For consumers, this only applies to the extent that no legal provisions be restricted in the country in which the customer has his domicile or habitual residence. Jurisdiction for disputes with customers who are not consumers, legal entity under public law or public special assets, location of the provider.

Salvatoric Clause

The invalidity of any provision of these Terms will not affect the validity of the remaining provisions.
